Terms of Use
The terms you agree to by using EveryFiveDays.
Before you rely on this page: these terms are a standard set for a publication of this kind and have not yet been reviewed by a lawyer. Two details — the legal entity behind EveryFiveDays and the governing jurisdiction — are still marked as placeholders below. They will be completed, and the whole document reviewed, before launch.
1. Acceptance of these terms
By accessing or using everyfivedays.com (the “Site”), you agree to these Terms of Use. If you do not agree with any part of them, please do not use the Site.
These terms apply to every visitor, whether or not you subscribe to our newsletter or contact us.
2. Who we are
The Site is operated by [LEGAL ENTITY] (“EveryFiveDays”, “we”, “us”, “our”). References to “you” mean the person using the Site.
Contact details are on our Contact page.
3. Eligibility
The Site is intended for a general adult audience. It is not directed at children under 13, and we do not knowingly collect personal information from them. If you are under the age of majority where you live, please use the Site only with the involvement of a parent or guardian.
4. Permitted use, and what it excludes
We grant you a personal, non-exclusive, non-transferable, revocable licence to access and read the Site for your own non-commercial use.
You agree not to:
- Republish, sell, rent, sub-licence or commercially exploit any part of the Site.
- Copy or reproduce substantial portions of our content, in any medium, except as section 5 permits.
- Scrape, harvest, or use automated systems to extract content, except for search-engine crawlers obeying our robots directives.
- Use the Site or its content to train a machine-learning model without our written permission.
- Interfere with the Site’s operation or security, or attempt to gain unauthorised access to any part of it.
- Use the Site for any unlawful purpose, or in any way that could damage, disable or impair it.
- Remove or obscure any copyright, attribution or disclosure notice.
5. Intellectual property and quotation
All content on the Site — articles, headlines, illustrations, design, layout, code and branding — is owned by EveryFiveDays or its licensors and is protected by copyright and other intellectual property laws.
You may quote a short extract (as a guide, up to roughly 100 words) for the purposes of commentary, criticism, news reporting or review, provided you attribute it to EveryFiveDays and link to the original article.
You may not republish an article in full or in substantial part, reproduce it behind a paywall, or present our content as your own, without our written permission. To request permission, please get in touch.
Third-party trademarks and product names appearing on the Site belong to their respective owners, and their use does not imply any endorsement of us by them, or of them by us beyond what an article actually says.
6. Your submissions
Public comments are not enabled on the Site. If you send us anything — a correction, a question, a story idea, feedback — you confirm it is yours to send and does not infringe anyone’s rights, and you grant us permission to use it to improve our coverage, including publishing a correction that reflects it.
We are not obliged to act on, reply to, or keep confidential any unsolicited submission, and we cannot pay for ideas.
7. Affiliate relationships and advertising
The Site earns affiliate commissions. Some links are affiliate links, and if you buy through one we may be paid a commission at no additional cost to you.
The full detail — how links are marked, what commissions never influence, and which programmes we participate in — is set out on our Affiliate Disclosure page, which forms part of these terms.
8. No professional advice
This is the most important section on this page.
EveryFiveDays publishes general information and consumer product journalism. Nothing on the Site is medical, psychological, nutritional, fitness-professional, veterinary, legal or financial advice, and nothing on it is a substitute for a consultation with a qualified professional who knows your circumstances.
In particular:
- Our writing about sleep and cognitive performance is not a diagnosis and must not be used as one. Persistent sleep problems, cognitive changes or mood changes are reasons to see a doctor.
- Our writing about fitness technology is not a training prescription. Consult a physician before beginning or changing an exercise programme, particularly if you have an existing condition or an injury.
- Our writing about pet care is not veterinary advice. If an animal is unwell or behaving unusually, see a vet. No device or article replaces that.
- Data from a consumer wearable, tracker, or monitor is not clinical data, and we do not treat it as such.
Never disregard professional advice, or delay seeking it, because of something you read here. In an emergency, contact your local emergency services.
9. Accuracy, prices and product information
We research carefully and correct errors when we find them or when they are reported. We do not warrant that the Site is complete, current or error-free.
Product specifications, availability, and prices are set by third-party retailers and change without notice. We deliberately do not publish prices for that reason. Always confirm the price, specification and availability on the retailer’s own page before buying.
Articles reflect our understanding at the time of writing. Where an article has been revised, the date of revision is shown on it.
10. Third-party links and services
The Site links to third-party websites, including retailers. We do not control those sites and are not responsible for their content, their products, their pricing, their privacy practices or their terms.
A link is not an endorsement of everything on the destination site. When you leave EveryFiveDays, the other site’s terms and privacy policy apply, and you should read them.
Any purchase you make from a third party is a contract between you and that third party. We are not a party to it, and disputes about orders, delivery, returns, warranties or refunds must be taken up with the retailer.
11. Disclaimer of warranties
The Site and its content are provided “as is” and “as available”, without warranty of any kind, whether express or implied. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, or free of errors or harmful components, or that any defect will be corrected.
12. Limitation of liability
To the fullest extent permitted by law, EveryFiveDays and its owners, contributors and agents will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, data, goodwill, or purchases made in reliance on the Site, arising out of your use of or inability to use it.
Where liability cannot lawfully be excluded, our total aggregate liability to you is limited to one hundred United States dollars (US$100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, where the law does not permit that limitation.
13. Indemnification
You agree to indemnify and hold harmless EveryFiveDays and its owners, contributors and agents from any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the Site, or your violation of any law or third-party right.
14. Termination
We may suspend or withdraw access to the Site, in whole or in part, at any time and without notice. We may also change, suspend or discontinue any part of it.
Sections 5, 8, 11, 12, 13 and 16 survive any termination.
15. Changes to these terms
We may revise these terms from time to time. The revised version takes effect when it is published on this page, and the date it was last changed is shown at the foot of this page.
Continuing to use the Site after a change means you accept the revised terms. Material changes will be flagged clearly rather than made quietly.
16. Governing law and disputes
These terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts of that place for any dispute arising out of these terms or your use of the Site.
Before starting formal proceedings, we ask that you contact us — most problems are quicker to fix than to litigate.
17. Severability and entire agreement
If any provision of these terms is found unenforceable, that provision is severed and the rest remains in force. Our failure to enforce a provision is not a waiver of it.
These terms, together with our Privacy Policy and Affiliate Disclosure, are the entire agreement between you and us regarding the Site.
18. Contact
Questions about these terms can be sent through our Contact page.
